Özet

Maliye Bakanlığı yapmış olduğu düzenlemelerle daha önce ihtiyari olan elektronik fatura uygulamalarını bazı yükümlüler için zorunlu uygulama halinde getirmiştir. Zorunluluk kapsamındaki yükümlülerin efatura düzenlemeyip kağıt ortamında fatura düzenlemeye devam etmeleri halinde tebliğler ile belirlenen yaptırımlar benimsenmiştir. Tebliğ ile cezai yaptırımlar getirilmesi cezaların yasallığı ilkesine uygun düşmemiştir. E-faturanın eksik veya yanlış uygulaması belli bir süre yaptırıma tabi tutulmayıp sonrasında bu konuda suç ve cezaların yasallık ilkesine uygun bir şekilde belirlenerek vergi usul yasası çerçevesinde uygulamaya gidilmesi isabetli olacaktır.

Abstract

Ministry of Finance necessitated e-invoice applications, which were previously voluntary, for certain taxpayers, with a recent regulation made effective. Penalties, which were announced via communiqués, were adopted for taxpayers, who are subject to this new regulation, continuing to issue their invoices on hard copies insted of issuing e-invoices. The procedure of effecting penal charges via communiqués was not an act that is in compliance with the principle of legality of penalties. It will be logical not to subject partial or incorrect e-invoice application to any penalties for a certain time period and then define crimes and penalties in this regard, then to impose charges within framework of the tax procedure law.
