Özet

Türk vergi sistemi esas olarak beyan yöntemine dayanmaktadır. Beyan yöntemini tamamlayan diğer tarh yöntemlerinden biriside re’sen vergi tarhıdır. Re’sen vergi tarhı vergi matrahının tamamen veya kısmen defter, kayıt ve belgelere veya kanuni ölçülere dayanılarak tespitine imkan bulunmayan hallerde takdir komisyonları tarafından takdir edilen veya vergi incelemesi yapmaya yetkili olanlarca düzenlenmiş vergi inceleme raporlarında belirtilen matrah veya matrah kısmı üzerinden vergi tarh olunmasıdır. Re’sen vergi tarhı ile ulaşılmak istenen amaç, ödenmesi gereken vergilerin doğruluğunu gerçek veya gereğe en yakın haliyle tespit etmektir..Başka bir ifade ile re’sen tarh yoluyla, vergi kayıp ve kaçağının önlenmesi ve vergide adaletin sağlanması amaçlanmıştır. Vergi Usul Kanunu’nun 30’uncu maddesinde genel tarh nedeni yanında ayrıca özel tarh nedenleri de belirtilmiştir. Bu madde kapsamında genel re’sen tarh nedenine yer verildiği için, yedi bentte sayılan özel tarh nedenleri sınırlayıcı değildir.

Abstract

The Turkish tax system mainly based on the declaration method. One of the other methods that completes the declaration method is exofficio tax imposition. The ex-officio tax imposition, the tax base, in whole or in partially records and documents or cases not possible to determine the legal basis of the measurements appreciated by those authorized to make tax review commissions or regulated as assessed by the tax inspection reports that it did not impose tax on the portion of taxable income. The aim of the ex-officio tax imposition is to determine the tax that is real or as close to reality that must be paid. In other words, through the impositon of its own motion and prevention of tax avoidance and evasion is intended to ensure tax justice. In the thirtieth article of the Tax Procedure Law, besides general imposition reasons, the special imposition reasons are also indicated.
