Özet
Vakıflar gelir veya kurumlar vergisi mükellefi değildirler. Ancak vakıfların gelir ve kurumlar vergisi mükellefi olmamaları hiçbir şekilde vergi ödemedikleri anlamına gelmemektedir. İktisadi işletmeleri hariç tutulsa bile, vakıflar çalıştırdıkları kişiler için gelir vergisi (muhtasar) beyannamesi vermek, bankada değerlendirdikleri paralardan elde ettikleri gelirler nedeniyle tevkifat yapılmak veya sahip oldukları gayrimenkuller için emlak vergisi ödemek gibi farklı şekillerde vergiye tabi tutulurlar. Ancak devletin kamu hizmeti yükünü azalttığına karar verilen vakıflara (Bakanlar Kurulu kararıyla vergi muafiyeti tanınan vakıflara), diğer vakıflardan farklı olarak birtakım vergisel avantajlar sağlanmaktadır. Bir vakfın vergiden muaf tutulabilmesi için Maliye Bakanlığının önerisi ve Bakanlar Kurulu Kararı gerekmektedir. Vakıfların vergi muafiyetinden yararlanması ve muafiyetlerinin kaybedilmesine ilişkin usul ve esaslar Maliye Bakanlığınca belirlenir.
Abstract
Foundations are not income tax, or institutional tax payers. However, the fact that the foundations are not income tax, or institutional tax payers, does not mean that they are totally exempt from paying taxes. Even if their economic enterprises are exempt, the foundations are subject to taxation in various ways. For example they are obligated to file income tax returns for their employees, they have to deduct their investment incomes in the banks, or they have to pay property tax on real property that they own. However, foundations which have deemed to minimize some of the public service responsibilities of the State (Tax exempt foundations by the decree of the Council of Ministers), are afforded some other tax advantages, different from the ones that other foundations would have. For a foundation to be tax exempt, there has to be a proposal by the Department of Finance, and a decision by the Council of Ministers. Procedures, and principles on a decision of a foundation to benefit from tax exemption, and a decision to lose the tax exempt status, are decided by the Department of Finance.
