Özet
Gelir Vergisi Kanunu'nda gayrimenkul alım satımından elde edilen kazanç, ticari kazanç veya değer artış kazancı olarak vergilendirilmekte- dir. Ancak iktisap ş ekline veya süresine bağlı olarak bazı gayrimenkul satış ları gelir vergisinin kapsamı dış ında bırakılmış tır. Gayrimenkullerin iktisap tarihinden itibaren beş yıl içinde elden çıkarılmasından sağlanan kazançlar değer artış kazancı olarak gelir vergisine tabidir. Kayıt dış ı ekonominin yoğun olduğu sektörlerin baş ında gayrimenkul sektörü gel- mektedir. Gayrimenkul sektöründeki vergi kayıp ve kaçağının temel nedeni vergi mevzuatındaki eksiklikler, Emlak Vergisi değerlerinin ger- çek değerinin altında belirlenmesi ve sektörde faaliyet gösteren kurum ve kiş ilerin kayıt dış ı çalış malarıdır. Vergi mevzuatımızdaki eksiklikler ise bu kayıt dış ılığı desteklemektedir. Gayrimenkul sektöründeki vergi kayıp-kaçağının önlenebilmesi için bir takım çalış maların, idari ve yasal düzenlemelerin yapılması gerekmektedir.
Abstract
Under the income tax law, income earned through real estate transactions, is taxed as business income, or appreciation in value income. However, depending on their acquisition manner, or length, some real estate sales are left outside the scope of income tax. Income gained through the sales of real estate within five years of acquisition are taxed as income tax based on earnings due to appreciation in value. The real estate sector is the leading sector among the sectors where there is intense underground economy. The main reasons for tax loss, and tax evasion within the real estate sector are: inadequacies under the main civil tax law; under apprasing of the real estate tax values; and the illicit activities of the institutions, and the people who are operating within this sector. Moreover, the inadequacies in our tax law help to support these illicit activities. Some studies need to be conducted, and some administrative, and legal regulations need to be implemented, in order to prevent the tax loss-tax evasion within the real estate sector.
