Özet

Türk vergi sistemi esas itibariyle beyan esasına dayanmaktadır. Mükelleflerin kendileriyle ilgili bilgileri en iyi kendilerinin bileceği temeline dayanan beyan esası modern vergi sistemlerinin ortak özelliklerinden biridir. Beyan sisteminin sağlıklı işlemesi pek çok unsurun yanında etkin bir vergi denetim sitemine bağlıdır. Vergi idaresi mükelleflerin beyanları çeşitli yöntemlerle kontrol etmeye çalışmakta olup bu yöntemlerin en önemlisi vergi incelemesidir. Vergi inceleme elemanları çeşitli inceleme yöntemleri ve vergi güvenlik tedbirlerinden de yararlanarak denetleme görevini yapmaktadırlar, ancak bu denetleme ile de her zaman tüm mükellefleri denetleme imkânı bulunmamaktadır. Bu nedenle, çok büyük vergi kayıp ve kaçağı meydana gelebilmektedir. İhbar müessesesi, vergi kanunlarımızdan ayrı bir kanunla düzenlenmiş olup bu kanun 26.12.1931 tarih ve 1905 sayılı Kanun’dur. Vergi ihbarına ve ihbar ikramiyesine ilişkin usul ve esaslar, vergi incelemesi ve sonrası yapılacak işlemler ve ihbar ikramiyesinin vergisel boyutu bu yazının konusunu oluşturmaktadır.

Abstract

In essence, the Turkish tax system is based upon declaration. “Declaration”, which is one of the common characteristics of the modern tax systems, is based upon the tenet that taxpayers know themselves the best. In addition to many elements, an effective auditing system is necessary for the declaration system to work properly. Internal revenue service tries to check the taxpayers’ declarations through different methods; the most important of which is the tax audit. Tax auditors accomplish their auditing duties, through the use of different auditing methods, and tax security measures. However, it is not always possible to audit all taxpayers in this way. For this reason, there may be much tax evasion. The institution of informing is regulated under a special law that is separate from the Turkish tax law; it is the 26.12.1931 dated, and 1905 numbered Law. Procedures, and substance regarding tax informing, and informant rewards; tax audit, and the procedures in its aftermath; and the tax dimensions of the informant’s award constitute the subject matter of this paper.
