Özet
Vergi incelemelerinde maksat, mükelleflerin ödemeleri gereken vergilerin doğruluğu tespit ederek sağlamaktır. Vergi kaybının bu şekilde denetimle ortaya çıkarılması amacı sağlanırken hem kamunun hem de mükelleflerin bireysel haklarının korunması elzemdir. Yasama ve İdare tarafından da söz konusu hakların korunması için kesin ve keskin hükümler getirilmektedir. Vergi incelemelerinin kapsam ve türünün belirlenmesi de bu minvalde olmuştur. Vergi incelemelerinin kapsamı, sınırlı ve tam inceleme olarak ayrılmıştır. Bu türden bir ayrım, hem vergi incelemelerinin süresini hem de kapsamını belirtecek şekilde yapılmıştır. Tam ve sınırlı incelemenin ne anlama geldiği ve uygulamaya nasıl yansıdığı anlatılacaktır. Ancak Vergi İncelemelerinde Uyulacak Usul Ve Esaslar Hakkında Yönetmelik'te yapılan değişiklik ile tam ve sınırlı incelemenin kapsamına yönelik ayrım zımnen ortadan kalkmış; sadece süresine yönelik ayrım devam etmektedir. Bu değişiklik her ne kadar, incelemelerin kapsamını daha da muhkemleştirmek adına yapılmış olsa da; incelemelerdeki verim ve çabukluğun tersine bir sonuç doğuracaktır
Abstract
The purpose of tax inspections is to determine the correctness of the taxation of the taxpayers. It is essential to protect the individual rights of both the public and taxpayers while ensuring that the loss of tax is controlled in such a manner. The Legislature and the Administration also provide precise and sharp provisions for the protection of the rights in question. It was also in this direction that the determination of the tax assessments was taken. The type of tax examinations is divided into a limited and a full examination. Such a distinction has been made to specify both the duration and scope of tax assessments. It will explain what the full and limited review means and how it is reflected in implementation. However, the amendment to the Regulation on the Procedures and Principles to be followed in the Tax Audits and the distinction of the scope of the full and limited examination has been totally abolished; The distinction is only going on for the time being. Although this amendment has been made in order to further strengthen the scope of the examinations, The results will be in the opposite direction to the yield and quickness in the examinations
