Özet

Gelir vergisi ve kurumlar vergisi gibi dolaysız vergilerde (kazanç vergilerinde) matrah tespit edilirken indirim konusu yapılan unsurlardan biri de geçmiş yıl zararlarıdır. Kurumlar Vergi Kanunu'nda kurumların bütün gelirleri ve giderleri ticari faaliyet olarak kabul edilmekte, ticari faaliyet içinde bütün olarak değerlendirilmekte ve hesap dönemi sonunda kâr veya zarar oluşmaktadır. Dolayısıyla tüm gelir unsurlarına ilişkin gelirler ve giderler kâr veya zarar tespitinde toplama dahil edilmektedir. Tüm faaliyet sonucu oluşan kâr vergilenmekte, zarar ise, sonraki yıl gelirlerinden belli şartlar çerçevesinde mahsup edilmek üzere devredilmektedir. Diğer bir ifade ile Türk vergi sistemimizde kurumların faaliyetleri sonucunda oluşan zararların belli şartlar çerçevesinde ileriki yılların kurum kazançlarından mahsubuna (indirimine) imkan verilmektedir. Kurumlar vergisi matrahının tespitinde yapılacak zarar mahsubunun esasları, Kurumlar Vergisi Kanunu'nun 9'uncu maddesinde yer almaktadır. Anılan madde hükmüne göre kurumlar vergisi mükellefleri, kurumlar vergisi beyannamesinde her yıla ilişkin tutarlar ayrı ayrı gösterilmek ve beş yıldan fazla nakledilmemek şartıyla geçmiş yılların beyannamelerinde yer alan zararları indirim konusu yapabilir. Geçmiş yıl zararlarının mahsubu hem Gelir Vergisi Kanununda hem de Kurumlar Vergisi Kanununda beş yıl ile sınırlandırılmıştır. Bunun nedeni, mükelleflerce bir hesap dönemi içerisinde oluşan zararın, beş hesap dönemi boyunca oluşacak karlarla mahsup edilememesi halinde sermayede meydana gelen bir eksilme olarak kabul edilmesidir

Abstract

In the case of direct taxes such as income tax and corporation tax, when the tax base is determined, one of the components of the tax deduction is the losses of the previous year. Institutions In the Tax Code, all income and expenses of the institutions are considered as commercial activities, they are evaluated as whole in the commercial activity and profit or loss occurs at the end of the accounting period. Therefore, income and expenses related to all income items are included in the determination of profit or loss. All activity is profit-generating and the loss is transferred from the following year's income to be deducted within certain circumstances. In other words, in our Turkish taxation system, the damages that occur as a result of the activities of the institutions are allowed to be deducted from the corporate gains of the following years within certain conditions. The principles of the deduction of the loss to be made in the determination of the corporation tax base are mentioned in Article 9 of the Tax Law. According to the provisions of the said article, corporations taxpayer taxpayers can deduct the amounts related to each year in tax declarations of corporations separately and to give discounts on losses in previous years' statements, provided that they are not transferred for more than five years. The deduction of previous year losses is limited to five years in both the Income Tax Law and the Corporate Tax Law. The reason for this is that taxpayers are considered to be a deficit in the capital if the loss incurred during the accounting period can not be offset by the profits to be generated during the five accounting periods
