Özet

Vergi hukukunda ispat, vergiye dayalı işlemlerdeki maddi olayın araç olarak delillerden faydalanmak üzere açığa çıkarılmasıdır. Vergi hukukumuzda vergiyi doğuran olay yemin hariç her türlü delille ispat edilebilmektedir. Buradan hareketle, serbest delil ilkesinin benimsenme- sinin nedeni, vergilendirmeye dair gerçek mahiyetin ortaya çıkartılması olarak ifade edilebilecektir. Ancak, her türlü delilin kullanılabileceğine yönelik bu ilkenin bazı sınırlamaları vardır ki bunlar, maddi gerçeğe ulaşmanın önünde engel durumundadır. İdari yargıda ve dolayısıyla vergi yargısında geçerli olan yazılılık ilkesi sebebiyle, yalnızca yazılı hale getirilmiş olan belgeler delil olarak değerlendirilebilecektir. Vergi hukukunda, usulünce oluşturulan, şekil şartlarını taşımak suretiyle yetkili makamlara ibraz edilmiş doküman belge olarak kabul edilebilecektir. Bu şartları taşıyan bir belgenin doğru olmadığını iddia eden, bunu ispat ile yükümlüdür. Vergi yargılamasında hâkim, re’sen araştırma yetkisine sahiptir. Vergi hâkimi, delilleri değerlendirirken hukuka uygunluk hususunu da dikkate almak suretiyle hukuk devleti olmanın bir gereği olarak idarenin eylemlerinin yargı denetimine tabi olması adına hukuka aykırılık teşkil eden delilleri dikkate alamayacaktır.

Abstract

Proof in tax law is to reveal by utilizing the evidence material event in transactions based on taxation as a tool.In our tax law, taxable events can be proved by any kind of evidence except oath. Moving from this, the reason for the adoption of the free evidence principle is to re- veal the true nature of taxation. However, there are some limitations of this principle that all kinds of evidence can be used. These limitations preclude access to material truth. Only written documents are evidence due to the principle of wri- ting in the administrative judiciaryand therefore in the tax judiciary. In tax law, accepted as a document submitted by the competent authorities by carrying the form requirements and duly created. The person who claims that the document bearing these conditions is not correct is obli- ged to prove it. In tax cases, the judge has the authority to investigate spontaneo- usly. The tax judge will not be able to take account of illegitimate evi- dence in the name of being subject to judicial review of the actions of the administration, taking into account the legality as well as the rule of law.
