BEPS PROJESİ SONUCU OECD VE BİRLEŞMİŞ MİLLETLER VERGİ ANLAŞMA MODELLERİNİN İŞYERİ KAVRAMINDA YAPILAN DEĞİŞİKLİKLER VE ETKİLERİ

Özet
Bilgi ve iletişim teknolojilerinde 20 nci yüzyılın sonlarındaki ge- lişme sayesinde ticaretin şekli ve süreçleri değişmiştir. Ekonomik faali- yetlerin bir kısmı bilgisayar ortamında ve internet üzerinden yapılmaya başlamıştır. Bu eğilim yakın gelecekte daha da hızlanacaktır. Bilgi ve iletişim teknolojilerindeki çok hızlı gelişim ekonomiyi önemli ölçüde etkilemiş ve dijital ekonomi kavramını ortaya çıkarmıştır. Ulusal eko- nomiler birbirleriyle daha fazla entegre olmuştur. Ekonomideki değişim geçen yüzyılın başlarında oluşturulan devletlerin vergi sistemlerini olumsuz yönde etkilemektedir. Bu yeni ekonomi anlayışı vergi hukuku- nun temel kavramlarından biri olan işyeri kavramı üzerinde etkili olmuş- tur. İşyeri kavramı işlevini yerine getirmez hale gelmiş ve devletlerin vergi sistemlerinde zafiyetler meydana getirmiştir. Zafiyetleri aşmak için ülkeler vergi sistemleri arasında uluslararası uyum arayışları başlamıştır. OECD/G20 BEPS Projesinin “Dijital Ekonominin Vergilendirilmesi Sorunları” ve “İşyeri Statüsünden Yapay Olarak Kaçınılmasının Önlen- mesi” başlıklı eylem planları önemli öneriler getirmiştir. Bu öneriler so- nucu OECD Vergi Model Anlaşmasının “İşyeri” başlıklı maddesinde ciddi değişikliler yapılmıştır. OECD Modelindeki değişikleri BM Mode- li izlemiştir. OECD Modelindeki değişikliklerin ülkelerin kendi aralarında ikili anlaşmalara doğrudan uygulanabilmesi için BEPS Çok Taraflı Anlaşmasını hazırlanmış ve imzaya açmıştır. Bu gelişmeler Türkiye’nin hem ülke içindeki vergi uygulamalarını hem de uluslararası vergi uygu- lamalarını önemli ölçüde etkilemektedir.
Abstract
The development of information and communication technologies in the late twentieth century has changed the shape and process of trade. Some of the economic activities have started to done in computer envi- ronment and on the internet. This trend will be even faster in the near future. The rapid development economy in information and communica- tion technologies has significantly influenced the digital economy con- cept. National economies have become more integrated with each other. The change in the economy affects the tax systems of the states which were created at the beginning of the last century negatively. This new understanding of the economy has been influential on the permanent establishment concept, which is one of the basic concepts of tax law. The permanent establishment concept has failed to function and has created weaknesses in the state's tax systems. To overcome weaknesses, coun- tries have begun to seek international harmony among their tax systems. The action plans of the G20/OECD BEPS Project entitled "Addressing the Tax Challenges of the Digital Economy" and "Preventing the Artifi- cial Avoidance of Permanent Establishment Status" made important suggestions. These proposals have resulted in serious changes in the OECD Tax Model Agreement entitled "Permanent Establishment". The changes in the OECD Model follow the UN Model. The BEPS Multilat- eral Agreement has been prepared and signed for the amendments to the OECD Model to be directly applicable to bilateral agreements between countries. These developments affect significantly both Turkey's domes- tic tax practices and its international tax practices.
