Özet
Taşınmazlar, sahipleri ya da ilgililere çeşitli mali yükümlülükler getirmektedir. Taşınmazın gerçek değeri üzerinden hesaplanması gereken bu mali yükümlülükler, taşınmaz değerinin olması gerekenden düşük belirlenmesi halinde Devlet; yüksek belirlenmesi halinde ise mükellef aleyhine sonuçlara yol açmaktadır. Oysa vergi adaleti ilkesi herkesin mali gücüne göre vergilendirilmesini gerektirir. Bu çalışmada, taşınmazların vergi adaleti ilkesine uygun olarak vergilendirilmesinde kadastronun önemi incelenecektir. Temel olarak taşınmazların mülkiyet ve coğrafi sınırlarına ilişkin bilgiler içeren kadastro kayıtları, taşınmaza ait çeşitli güncel verileri sağlayabilecek en elverişli veri kaynağı olarak değerlendirilmektedir. Tarihte ilk olarak mali amaçlarla tutulan kadastro kayıtları, ilerleyen zamanlarda taşınmazın mülkiyet ve coğrafi konumuna ait bilgileri de içeren bir kaynak haline gelmiştir. Ülkemizdeki kadastro ise taşınmazların sadece mülkiyet ve coğrafi konumlarına ait bilgileri içeren ve güncellenmeyen kayıtlara dayandığından, vergilendirme işlemlerinde bir bilgi kaynağı olarak kullanılamamaktadır. Gelişmiş ülkelerde uygulanan kadastro sistemine geçilmesi, ülkemizin arazi politikasının belirlenmesinde önemli bir adım olmanın yanında, taşınmazların vergi adaleti ilkesine uygun olarak vergilendirilmesine de katkı sağlayaca
Abstract
Real estate impose various financial obligations on their owners or related parties. These financial obligations, which need to be calculated over the real value of the real estate, if the value of the real estate is determined lower than it should be, the State; If it is determined high, it causes results against the taxpayer. However, the principle of tax justice requires that everyone be taxed according to their financial strength. In this study, the importance of cadastre in taxation of real estate in accordance with the principle of tax justice will be examined. Basically, cadastral records, which contain information about the ownership and geographical boundaries of the real estate, are considered to be the most convenient data source that can provide various up-to-date data on the immovable. Cadastral records, which were first kept for financial purposes in history, later became a source that includes information about the ownership and geographical location of the real estate. The cadastre in our country cannot be used as an information source in taxation transactions, since it is based on records that contain only the ownership and geographical location of the real estate and are not updated. The transition to the cadastral system applied in developed countries will not only be an important step in determining the land policy of our country, but will also contribute to the taxation of real estate in accordance with the principle of tax justice
