Özet
Türkiye’de Bireysel Emeklilik Sisteminin 2001 yılında başlangı-cıyla birlikte uygulanan yaklaşım; emeklilik tasarruflarının vergi matra-hından düşülmesini, emeklilik tasarruflarının getirisinin birikim sürecin-de vergilendirilememesini ancak emeklilik ödemelerinin vergilendiril-mesini içermektedir. Bu haliyle bir harcama vergisi (expenditure tax) uygulama örneği olan yaklaşım, tasarruf aşamasında ödenen vergilerin telafi edilememesi nedeniyle çifte vergilendirme eleştirilerine konu ol-muştur. 2012 yılından itibaren emeklilik tasarruflarının vergi matrahın-dan indirilmesi uygulaması terk edilerek bu tasarruflara devlet katkısı uygulanmaya başlamıştır. Vergi mükellefi olmasından bağımsız olarak bütün katılımcılar devlet katkısından yararlandığından bu uygulama da-ha geniş kapsamlıdır. Ayrıca devlet katkısı, tasarruf sahibinin marjinal vergi oranından bağımsız hesaplanmakta, bu yönüyle öncelikle düşük gelirli tasarruf sahiplerini desteklemeyi hedeflemektedir. Öte yandan devlet katkısı, tasarruf aşamasında ödenen vergilerin telafi edilmesinin bir aracı olmaktadır. Mevcut uygulamada emeklilik ödemelerinin sadece irat kısmının vergilendirilmesi, vergi öncesi gelirlerle yapılan veya dev-let katkısı ile vergisi telafi edilen tasarrufların tümüyle vergi dışında kalmasına neden olmaktadır. Aynı zamanda bu uygulama, getiri aşama-sında yapılması gereken vergilemenin emeklilik ödemesi yapılana kadar ertelenmesi anlamına gelmektedir.
Abstract
In 2001, with the beginning of Private Pension System in Turkey, the initial approach contained deduction of pension savings from the tax base and not taxing the return during accumulation phase however taxing pension payments. This approach, which is an example of a expenditure tax practice, has been the subject of double taxation criti-cism due to the taxes paid at the saving stage cannot be compensated. With the amendment made in 2012, the practice of the deduction of pen-sion savings from the tax base was abandoned and the public subsidy to the pension savings started to be applied. This practice is far more comprehensive than the previous one, since all participants, regardless of whether they are taxpayers, benefit from the public subsidy. In addi-tion, the public subsidy is calculated independently from the marginal tax rate of the savings holder and therefore aims to support low-income savings holders. On the other hand, the public subsidy is a means of compensating the taxes paid at the saving stage. Since, current practice comprimises only taxation of return of savings, savings that made with pre tax income and compensation of taxes that paid for personal savings by means of the public subsidy become entirety nontax. At the same time, taxing only the returns of savings means that postponed the taxation un-til pension payments are made.
