Özet
Milli ekonomiye fayda sağlaması amacıyla geliştirilen enstrüman- lar içinde konkordato, günümüz ekonomik koşullarına uygun olarak ye- niden yapılandırılmıştır. Konkordato talebi için mahkemeye sunulan ön projenin inceleme ve denetimi işletmenin iyi niyetli olup olmadığının anlaşılması bakımından önem arz eder. Muhasebe operasyonlarının ko- lay tespit edilemediği ve bu yolla hileli işlemlerin yapılabildiği kayıt sisteminin denetimi için konkordato komiseri görevlendirilmektedir. Ancak firmaların sermaye kaybı ve borçlarını ödeyebilme aczinde oldu- ğunu ileri sürerken mali tablolarında vergi matrahını azaltacak işlemlere yönelmiş olmaları mümkündür. Konkordato talebi öncesinde firmanın mevcut durum ve borçlarına ilişkin maddi ve hukuki gerçekliğin gizlen- mesi bu durumun vergi hukuku bakımından doğuracağı sonuçlar hazine- nin kaybına sebep olması yönüyle ayrı bir değerleme konusu görülmüştür.
Abstract
Concordat, among the instruments developed in order to avail na- tional finance, has been restructured in accordance with current finan- cial conditions. Examination and supervision of preliminary project submitted to the court for concordat request has been significant in terms of understanding if the enterprise is in good faith or not A trustee in composition is appointed to monitor the registration system at which accounting operations cannot be detected easily and fraud operations can be performed in this way. However, while the com- panies claim they are unable to pay their capital loss and debts, it is li- kely that they tend to perform operations that will reduce their assess- ment in financial statements. The fact that the company hides the legal reality and existing situation regarding its debts and the results caused by this situation in terms of tax law prior to concordat request give rise to loss of public treasury, which is considered as another assessment subject.
