Özet
Çağdaş vergi sistemleri, mükelleflerin kendilerinin vergilendirilecek kazançlarını beyan esasına dayanmaktadır. Bunun yanında devlet otoritesi beyanları kontrol etme yetkisini haizdir. İlgili kamu otoritesi, çoğunlukla vergi müfettişleri, tarafından yapılan denetimler sonucunda ilave vergi borcu oluşabilmektedir. İşte devlet otoritelerinin ilave vergi önerisi dava sonucu, indirim talep etme gibi yöntemler yanında uzlaşma yoluyla da kesinleşebilir. Türk vergi sisteminde tarhiyat öncesi ve sonrası uzlaşma bulunmaktadır. Uzlaşma, mükelleflerin adlarına yapılan tarhiyatı yargıya intikal ettirmeden önce, vergi idaresi ile tahakkuk edecek vergi ve ceza hususunda anlaşmak için başvurabilecekleri idari bir çözüm yoludur. Kamu alacağının kısa sürede tahsilini sağlayan uzlaşma yolu, aynı zamanda mükellefin yargı sürecinde katlanacağı maliyetleri ve bürokratik işlemleri de ortadan kaldırmaktadır. Buna mukabil, özellikle merkezi uzlaşma görüşmelerinde zaman zaman yüksek oranda vergi ve cezada indirim yapılması gündeme gelebilmektedir. Uzlaşma süreci aslında vergi inceleme sürecinin devamı niteliğindedir. Bu nedenle vergi inceleme sürecinin kalitesini artırmak uzlaşmanın kalitesine etki edebilecektir. Bu şekilde, yüksek miktarda vergi ve ceza önerilerinin görüşüldüğü merkezi uzlaşma komisyonu da her türlü baskının dışına çıkabilecektir.
Abstract
Contemporary tax systems are based on the principle of declaring taxpayers' taxable incomes. In addition, the state authority has the power to check these declarations. Additional tax debt may occur as a result of the audits performed by the relevant public authority, mostly tax auditors. Here, state authorities' additional tax proposal can be finalized through a litigation process, requesting a discount as well as compromise. In Turkish tax system, there are two types of compromises, before and after the calculation of owed tax amount. Compromise is an administrative solution that taxpayers can apply to agree on tax and penalties to be accrued with the tax administration before bringing the assessment on their behalf to the judiciary. Through compromise, which provides the collection of public receivables in a short time, also eliminates the costs and bureaucratic procedures that the taxpayer will bear during the judicial process. On the other hand, compromise may attract the attention of public, from time to time, because of large amount of deduction in taxes and penalties owed before central compromise commission. The compromise process is in fact the continuation of the tax audit process. Therefore, increasing the quality of the tax audit process may affect the quality of the compromise. By way of this, central compromise commission, where large amount tax and penalty suggestions are discussed, may also get out of every kind of pressure.
