Özet

Vergilendirmenin temel kurallarını düzenleyen Anayasa’nın 73/2 hükmünde, vergi yükünün adaletli ve dengeli dağıtımının maliye politi-kasının sosyal amacı olduğu belirtilmiştir. Adalet ilkesi olarak adlandırı-lan bu ilke, politika uygulayıcılara çok önemli bir sorumluluk yüklemiş ve keyfi düzenlemeleri önleyici kesin emredici sınırlamalar getirmiştir. Vergilendirme aşamasında uyulması gereken bu çok önemli ilke, bu ça-lışmada inceleme konusu yapılmış ve içerik olarak neyi kapsadığı litera-tür taraması yoluyla doktrin ve Anayasa Mahkemesi kararları çerçeve-sinde analiz edilmiştir. Yapılan değerlendirme sonucunda vergi yükünün adaletli ve dengeli dağılımı ilkesinin aslında mali güç ve genellik ilkeleri ile birlikte değerlendirilmesi gerektiği ve ilkenin sosyal devlet uygula-masının vergilendirme açısından tekrar vurgulanması amacıyla düzen-lendiğine ulaşılmıştır.

Abstract

According to article 73/2 of the Turkish Constitution, which regu-lates the basic rules of taxation procedures, it is stated that the fair and balanced distribution of the tax burden is the social purpose of the fiscal policy. This principle, which is called the principle of justice, imposes a very important responsibility on policy practitioners and imposes strict mandatory limitations to prevent arbitrary regulations. This very impor-tant principle that must be followed during the taxation phase has been examined in this study and its content has been analyzed within the fra-mework of doctrine and Constitutional Court decisions through literatu-re review. As a result of the evaluation, it was found that the principle of fair and balanced distribution of tax burden should actually be evalua-ted together with the principles of ability to pay and equity and that the principle was arranged in order to emphasize the social state practice in terms of taxation.
