(THE CODE CONTRADICTING THE REGIME OF ROMAN REPUBLIC: LEX GABINIA DE PIRATIS PERSEQUENDIS)

Özet

Roma Cumhuriyet Dönemi, devletin mevcut organları arasındaki güç dengesiyle ve demokratik unsurlarla yönetildiği siyasi dönemdir. Beş yüz yıllık sürece yayılan bu dönem, tarihi süreç içinde ekonomik, toplumsal ve siyasal sebeplerle değişime uğramış ve Roma İlk İmparatorluk Dönemi’ne geçiş süreci yaşanmıştır. Bu süreçte rejim değişikliğine yol açan sebepler, somut uygulamalara da dönüşecektir. Uzun zaman askeri ve politik alanda devleti meşgul eden korsanlık sorunu, M.Ö. I. yüzyılda hukuki düzenlemelerle çözülmeye çalışılmıştır. Bu düzenlemelerden M.Ö. 67 tarihli Lex Gabinia de Piratis Persequendis isimli kanun, Gnaeus Pompeius Magnus’a bulunduğu görevin sınırlarını aşacak derecede ve çeşitte yetkiler tanıyarak, cumhuriyet rejiminin yapısı ile çelişen uygulamalara yer vermiştir. Kanunun uygulanması ile ortaya çıkan sonuçlar, devleti rejim değişikliğine götüren sürecin bir parçası olmuştur.

Abstract

The Roman Republican Period is the political period in which the state is governed by the balance of power between existing bodies and democratic elements. This period, which spans five hundred years, has undergone changes due to economic, social and political reasons during the historical process and has undergone a transition to the Early Roman Imperial Period. In this process, the reasons that led to the regime change will also turn into concrete adhibitions. The problem of piracy, which had occupied the state for a long time regarding the military and political sphere, has been tried to be solved by legal regulations in the first century B.C. One of these regulations, The Lex Gabinia de Piratis Persequendis code dated 67 B.C., has included practices that contradict the structure of the republican regime, by granting Gnaeus Pompeius Magnus authority, in a degree and in a variety of ways to exceed the limits of his position. The results of the implementation of the code were part of the process that led the state to change the regime.
