Özet

Tüketici kredilerinde cayma hakkı tanınması tarihi çok eski değildir. 28 Mayıs 2014 tarihinde yürürlüğe giren 6502 s.K. ile ilk defa getirilmiştir. 6502 s. K. üç tip tüketici kredisi düzenlemiştir: Tüketici kredisi, konut finansmanı sözleşmesi, ön ödemeli konut satış sözleşmesi. Her üç tip sözleşme için de tüketici kredisi söz konusu olabilmektedir. Ancak cayma hakkı bakımından Kanun konut finansmanı sözleşmelerini diğer iki tip tüketici kredisi sözleşmesinden ayırmış ve konut finansmanı sözleşmelerinde cayma hakkını öngörmemiştir. Diğer iki tip kredi sözleşmesinde öngörüp, konut finansmanında öngörmemiş olmasını kanun koyucunun iradesi olarak yorumlamak zorundayız. Kanunkoyucunun konut finansmanında cayma hakkını düzenlemeyi unutmuş olabileceğini düşünemeyiz. Kanun, cayma hakkı konusunda genel bir tanım vermemektedir. Oysa, Kanun genl bir tanımlama yapmış olsa ve her türlü tüketici işlemi bakımından geçerli olacak bir düzenleme getirmiş olsa daha isabetli olacak idi. Kanun genel bir tanımlama yapmamış olmanın yanı sıra cayma hakkının hukuki niteliğini de düzenlememiştir. Ancak genel hükümlerden ve düzenleme dilinden anlaşıldığı kadarıyla, tüketici kredilerinde cayma hakkı bozucu yenilik doğuran bir hakkın kullanılmasıdır. Bu nedenle de şarta bağlanması mümkün değildir.

Abstract

The right of withdrawal in consumer loans was introduced at a recent date. It was firstly introduced together with the law no 6502 s.K., which entered into force on 28 May 2014. Law no 6502 s.K. has regulated three types of consumer loans: consumer loan, housing financing agreement, and paid housing sales agreement. The consumer loan can apply for all three types of contract. However, in terms of the right of withdrawal, the law separates the housing finance contracts from the other two types of consumer loan agreements and does not provide for the right of withdrawal in these types of agreements. We have to interpret the stipulation in the other two types of loan agreements but not in housing finance contracts as the will of the legislator. We cannot imagine that the lawmaker may have forgotten to regulate the right of withdrawal in housing finance. The law does not give a general definition on the right of withdrawal. However, if the Law had made a general definition and introduced a regulation that would be valid for all kinds of consumer transactions, it would have been hitting on point more. In addition to not making a general definition, the law has not regulated the legal nature of the right of withdrawal. However, as understood from the general provisions and the language of regulation, the nature of the right of withdrawal in consumer loans is the exercise of a dissolving design right. Therefore, it is not possible to be stipulated.
