Özet
Telafi çalışması, belirli nedenlerle işin durması halinde çalışılma-yan sürenin daha sonra fazla çalışılarak telafi edilmesi anlamına gelir. Hukukumuzda İş Kanunu’nun 64. maddesinde, zorunlu nedenlerle işin durması, ulusal bayram ve genel tatillerden önce veya sonra işyerinin tatil edilmesi veya benzer nedenlerle işyerinde normal çalışma süreleri-nin önemli ölçüde altında çalışılması veya tamamen tatil edilmesi ya da işçinin talebi ile kendisine izin verilmesi hallerinde, işveren tarafından kanunda belirlenen süre içerisinde telafi çalışması yaptırabileceği düzen-lenmiştir. Covid-19’un tüm dünyayı takiben ülkemizi de yaygın olarak etkilemesi üzerine, telafi çalışmasına ilişkin kanuni düzenlemede deği-şiklik yapılarak, işverenin iki ay içerisinde yapmakla yükümlü olduğu telafi çalışmasının süresi 4 aya çıkarılmıştır. Çalışmamızda, Türk ve İsviçre Hukukundaki yasal düzenlemeler dikkate alınarak, genel olarak telafi çalışması ve koşulları açıklanmaya, özellikle zorlayıcı nedenle telafi çalışması ve telafi çalışmasına ilişkin olarak pandemi sürecinde doğan sorunlar incelenmeye çalışılacaktır.
Abstract
Compensatory work means that, in case the work has been sus-pended or stopped due to certain reasons, the unworked time is compen-sated by working overtime later. In Turkish Law, compensatory work has been determined under the Article 64 of Turkish Labour Law, num-bered 4857, as in cases where time worked has been considerably lower than the normal working time or where operations are stopped entirely for reasons of suspending work due to force majeure or on the days be-fore or after the national and public holidays or where the employee is granted time off upon his request, the employer may call upon compen-satory work in order to compensate for the time lost due to unworked periods. Upon the widespread impact of Covid-19 on our country fol-lowing the whole world, the legal regulation regarding the compensa-tory work was amended, and the duration of the compensatory work that the employer is obliged to do within two months was increased to 4 months. In our study, the compensatory work and its conditions shall be tried to explain, by considering the legal regulations in both Turkish and Swiss Law, and the problems arising during the pandemic process, espe-cially with regard to force majeure shall be tried to examined.
