Özet
Türk hukukunda ilk kez 1961 Anayasası döneminde anayasal bir hak olarak tanınan grev hakkı, günümüzde temel olarak 1982 Anayasası ve 6356 sayılı Sendikalar ve Toplu İş Sözleşmesi Kanunu ile düzenlen-mektedir. Önceki 2822 sayılı Toplu İş Sözleşmesi Grev ve Lokavt Ka-nunu ile karşılaştırıldığında, yürürlükteki mevcut kanun ile toplu iş uyuşmazlıklarının çözümüne ilişkin önceki dönemde ortaya çıkan mese-lelerin bertaraf edilmesi ve ILO (Uluslararası Çalışma Örgütü) organla-rının kararlarına kısmen de olsa uyum sağlamak amacıyla bazı farklı düzenlemeler getirilmiştir. Tüm bu çabalara rağmen, iki kanun arasında konumuz bakımından pek büyük bir farkın olmadığı söylenebilir. Bu çalışmada, kanuni grevin şartları ve hukuki sonuçları incelenecektir.
Abstract
The right to strike, which was first recognized as a constitutional right in the time of the Constitution of 1961, is nowadays fundamentally regulated by the Constitution of 1982 and Code No.6356 on Syndicates and Collective Labor Agreement. Compared to previous Code No.2822 on Collective Labor Agreement Strike and Lockout, with the actual Code in effect, some different regulations are brought in order to eliminate the problems which arised during the preceding period, as well as to comply with the decisions of the International Labor Organization (ILO). In spite of all these efforts, it could be said that there is not much difference between the two codes in respect to our subject. In this study, the condi-tions and legal consequences of legal strike are going to be examined.
