Özet

Deniz yoluyla yapılan eĢya taĢımalarında taĢıma iĢi, çoğu halde, akdi taĢıyandan baĢka kiĢiler tarafından yerine getirilir. Yük veya gecikme zararları nedeniyle sorumlu tutulmaları söz konusu olabilecek bu kiĢiler ile zarar gören arasında akdi bir iliĢki çoğu zaman yoktur. Türk Ticaret Kanunu (“TTK”), bu durumu dikkate alarak fiili taĢıyanın sorumluluğu hakkında düzenleme getirmiĢtir. Ancak, deniz yolu ile eĢya taĢımacılığı alanında fiili taĢıyanı hükme bağlayan TTK m.1191‟de tanım yapılmamıĢ olması, fiili taĢıyan sayılacak kimselerin belirlenmesinde bazı tereddütlere yol açmıĢtır. Bu çalıĢmanın amacı, Deniz Ticareti Hukukunun bir özelliği olarak görülen aynı gemi üzerinde kurulmuĢ deniz ticareti sözleĢmeleri silsilesinde yük veya gecikme zararı nedeniyle fiili taĢıyan sıfatıyla sorumlu tutulabilmesi mümkün kiĢileri açığa çıkartmaktır.

Abstract

Carriage of goods by sea is mostly conducted by other persons than the contractual carrier. Most of the time, there exist no contractual relation between the persons who may be held liable due to delay or cargo damages and the injured party. Turkish Commercial Code, taking this situation into account, has regulated the liability of the contractual carrier. However, the fact that no definition has been given in the art. 1191 of Turkish Commercial Code regulating the actual carrier in the field of transportation of goods by sea, causes hesitations while determining the persons who will be deemed as actual carriers. The aim of this study is to reveal the persons who can be held liable as the actual carrier due to delay and cargo damages within the series of contracts drawn up on the same vessel, which is seen as one of the features of the Commercial Maritime Law.
