Özet

To be able to understand a written or an oral material, it should be interpreted. It requires to be interpreted to comprehend its meaning and purpose. Legal resources also need to be interpreted. This interpretation is called legal interpretation and it is practiced by means of certain interpretation methods. One of these interpretation methods is purposive interpretation. The purposive interpretation in law developed by Aharon Barak as an interpretation system includes other methods of legal interpretation, such as grammatical (literal), systematic and historical interpretation methods, and uses them in the interpretative process. This system consists of three components: Language, purpose and discretion. These components complement each other and are applied in order. After all these phases, the interpreter reaches the ultimate purpose of the legal text. He or she discovers the legal norm and legal meaning of this legal text. Thus, purposive interpretation achieves its purpose of existence.

Bu sistem, üç parçadan oluĢur: Dil, amaç ve takdir. Bu parçalar, birbirini tamamlar ve sırayla uygulanır. Bütün bu aĢamaların sonunda yorumcu, hukuki metnin nihai amacına ulaĢır.
