Özet

Evlilik dışı ilişkinin İslâm Hukuku’ndaki cezası, recm veya yüz değnek sopa cezası şeklinde uygulanan hadd cezalarıdır. Fakat suçun ispat şartlarındaki güçlükler veya suçun unsurlarındaki eksiklikler nedeni ile genellikle bu cezalar hapis ve sürgün şeklindeki tazir cezalarına dönüştürülmüştür. Osmanlı Devleti’nde bu cezalara, örfi hukuktan gelen para cezaları da eklenmiştir. Ayrıca sürgün, hapis, kalebentlik, kürek ve ölüm cezaları da uygulanmıştır.

Abstract

Punishments for extra-marital affairs in Islamic law consisted of hadd (punitive) sentences such as rajm (stoning) or caning with one hundred strokes of the cane. But because of the difficulty of proving the crime or the lack of criminal elements, these sentences were generally turned into tazir (censure/chastisement) punishments such as prison or exile. In the Ottoman Empire, pecuniary fines, originating from civil law, were also added to these sentences. Moreover, exile, prison, confinement in a fortress, hard labor or death sentences were also given.
