Institutional Aspects of the Turkish Anti- dumping System: A Critical Assessment and a Reform Proposal

Türk anti-damping soruşturma makamı Ekonomi Bakanlığı İthalat Genel Müdürlüğü’dür. Anti-damping soruşturmalarını yürüten bu Genel Müdürlüktür. Ancak, bu soruşturmalardaki karar alma sürecinde önemli rol oynayan iki organ daha bulun- maktadır: İthalatta Haksız Rekabeti Değerlendirme Kurulu ve Ekonomi Bakanı. Hali hazırda, soruşturma makamının yapısı ve soruşturmalardaki karar alma süreci Türk sa- nayiinin ihtiyaçlarına cevap verememektedir ve değişmelidir. Bu çalışmada, daha şeffaf ve etkili bir anti-damping sisteminin oluşturulması amacıyla, hem soruşturma makamı- nın yapısında hem de karar alma sürecinde değişiklikler yapılmasını öneriyoruz.

Abstract

The Turkish investigating authority for anti-dumping investigations is the Directorate-General for Imports at the Ministry of Economy. It is this DirectorateGeneral that conducts anti-dumping proceedings. As far as the decision-making process is concerned, there are two other actors that also play an important role, namely, the Board on the Prevention of Unfair Competition in Imports, and the Minister of Economy. Neither the structure of the investigating authority nor the decision-making process responds to the needs of the Turkish industries. They therefore have to be modified. We propose to modify both the structure of the investigating authority and the decision-making process in a way that would create a more transparent and effective anti-dumping system.
