Özet

l Kasım 1993 tarihinde yürürlüğe giren Avrupa Birliği Kurucu Antlaşması 'mn V, Kısmı ortak dış politika, güvenlik ve savunma konularını düzenlemektedir. AB Kurucu Antlaşması düzenlemeleri itibarıyla bu alanlara yönelik, üye devletler arasında genel anlamda bir uzlaşma sağlanmıştır. Ancak, kimi devletlerin (örneğin Danimarka) bu konularda ulusal çıkarlarını ön planda tutma çabaları, uzlaşmayı olumsuz yönde etkilemektedir. Bu durum da, bu konulara yönelik uzlaşmanın tam olarak sağlanamadığını göstermektedir. AB Kurucu Antlaşması 'nda yer alan ortak dış politika, güvenlik ve savunma konuları klasik devletler hukuku karakterindedir. Üye devletler, bu konulara ilişkin egemenlik yetkilerinden feragatte bulunmamışlardır. Yine üye devletler, bu konularda büyük boyutlarda oybirliği ile karar tesis etmeyi amaçlayarak veto yetkisini korumak istemektedirler. Bu anlamda da, ortak dış politika, güvenlik ve savunma konuları Avrupa Toplulukları Adalet Divanı 'mn yargı yetkisine konulmamıştır.

Abstract

The fifth title of the Treaty on European Union, which entered into force in 1 November 1993, regulates the matters related with the common foreign, security and defence policies. A consensus has been reached among the member states according to the provisions of the Treaty about these issues. However the efforts of some member states (e.g. Denmark) for keeping their national interests affect the consensus negatively. This situation reveals that a real consensus could not be established completely among the member states yet. The provisions in the Treaty that are related with the common foreign, security and defence policies have a classical international law character. The member states haven't renounced completely their powers concerning with sovereignty about these topics. Nevertheless, member states whilst they are aiming at making unanimous decision in these subjects, would like to save their veto powers. Therefore, these topics haven't been settled under the jurisdiction of Court of Justice.
