Özet
Bu makalede Türk belediye sisteminin Fransa’dan iktibas edilip edilmediği sorunu incelenmektedir. Bu sorunu çözmek amacıyla 3 Nisan 1930 tarih ve 1580 sayılı Belediye Kanunu hükümleri ile 5 Nisan 1884 tarihli Belediye Teşkilatı Hakkında Fransız Kanun hükümleri arasında karşılaştırma yapılmıştır. Karşılaştırma sonucunda Fransız ve Türk belediye sistemleri arasında, organların oluşumları, çalışma usûlleri, görev ve yetkileri ve kararlarının uygulanması bakımından pek çok benzerliğin olduğu gözlemlenmiş ve Türk belediye sisteminin Fransız sisteminden büyük ölçüde esinlendiği sonucuna ulaşılmıştır.
Abstract
This article examines the question of whether Turkish system of municipality is taken from the French system. In order to solve this problem, the Turkish Municipality Law of 3 April 1930 is compared with the French Law of 5 April 1884. It is observed that there are many similarities between Turkish and French systems of municipality, in terms of the formations of the organs, their working procedures, duties and powers and the enforcement of decisions, and it is concluded that the Turkish system of municipality is inspired by the French system.
