Anayasa Mahkemesi’nin Sıra Cetveline İlişkin Bir Kararının Değerlendirilmesi

Özet

Sıra cetvelinin kesinleşmesi sürecinde, icra dairesi yed’inde bulunan paranın nemalandırılmaması mülkiyet hakkını açıkça ihlâl etmektedir. İncelemeye konu kararda ortaya konulan ilkeler çerçevesinde sıra cetvelinin kesinleşmesi süreci ne kadar kısa olsa da icra dairesinde bulunan paranın nemalandırılması gerekmektedir. Nemalandırma ise idareye (icra dairesine) yük yüklemeyecek bir yöntemle yapılmalıdır. Çalışmamızda temel olarak kararda tartışılan asıl mesele olan sıra cetvelinin kesinleşmesi sürecinde ihale bedelinin nemalandırılmasını öngören bir yasal düzenleme bulunmayışının ihlâl teşkil edip etmediği ve bu ihlâlin giderimi meselelerine ilişkin inceleme yapılacaktır. Bununla beraber, karar diğer usûlî noktalardan ve esasa ilişkin noktalardan da değerlendirilecektir. İnceleme konusu kararın hâlihazırdaki etkileri ortaya konularak olması gereken etkileri de tespit edilmeye çalışılacaktır.

Abstract

The money lying idle in possession of the execution office, during the process of finalizing the collocation plan, manifestly violates the right to property. Pursuant to the principles laid out in the concerned decision, the money in the execution office should be invested, even if the process of finalization of the collocation plan takes a short time. The investment should be done in a way that does not burden the administration (execution office). In our study, the main issue discussed in the following decision is whether there is a violation due to a legal loophole with respect to the investment of the tender price in the process of finalization of the collocation plan and if it is possible to abstain from such a violation. Furthermore, the decision will be examined within the perspective of the other procedures and merits. The current effects of the relevant decision will be discussed and the impact that it should have (the ideal effects) will be analysed.
