Özet
Bu makalede Zahirî mezhebine göre “içtihat” ve “taklit” kavramları üzerinde durulacaktır. Zahiriler bu konuda diğer fıkıh eklollerinden bariz bir şekilde ayrılırlar. Onlara göre içtihat, her Müslüman için bir zorunluluktur. Ancak bunu yaparken kıyas, re'y ve istihsan gibi aklî ve insânî metotlardan uzak durulmalıdır. Fakihler dini bir meselenin hükmünü sadece Kur'an ve Sünnetin zâhirî anlamından çıkarmalıdır. Onlara göre taklit de caiz değildir ve kaçınılması gereken bir durumdur. Hiç kimse, hatta Sahabenin ileri gelenleri bile taklit edilemez. Bunlar taklit edilemeyeceğine göre daha sonraki dönemlerde gelen kimselerin, mezhep imamı olsa dahi, taklit edilmesi caiz değildir.
Abstract
In this article, we will focus on concepts of “ijtihad” (the process of making a legal decision by independent interpretation of the legal sources, the Qur'an and the Sunnah) and “taqlîd” (adherence to a madhhab) according to Zahiri legal school. Zahirities, in this subject, are clearly separated from other Islamic Schools of Law. For them, ijtihad is a necessity for every Muslim. But in doing so; one should avoid from rational and human methods such as kıyas (analogy), re'y (opinion) and istihsan (public interest). Jurists, concerning religious issues, should depend on the literal meaning of the sacred texts, such as Quranic Verses and Prophetic Traditions. By them, “taqlîd” is not permissible and should be avoided. Nobody, even the elders of Companions, should not be imitated. If it is not permissible to imitate them, then, other people who lived in the later periods can not be permissible to imitate, even if they are the leaders of legal schools.
