Vasinin Goreve Başlaması ve Gorevinin Sona Ermesi Aşamasında Vesayet Dairelerinin Gorev ve Yetkileri

Özet
Vesayet dairelerinin (vesayet makamı ve denetim makamı), vasinin görevini yürütmesi esnasında mevcut yetki ve görevleri (izin alınması gereken işlemler ile şikâyet ve itiraz) yanında, vasinin göreve başlaması ve görevinin sona ermesi akabinde de çeşitli görev ve yetkileri bulunmaktadır. Bu yetki ve görevler, vasinin göreve başlaması esnasında yapılması gerekli olan ve MK 438 ila 444. maddeleri arasında öngörülmüş olan iş ve işlemlere ilişkindir. Bu maddelerde, vasinin göreve başlarken yapılması gereken defter tutulması, değerli şeylerin saklanması, taşınır-taşınmazların satılması, paraların yatırılması, yatırımların dönüştürülmesine ilişkin iş ve işlemler ile bu kapsamda vesayet dairelerinin görev ve yetkileri düzenlenmektedir. Yine, vasinin görevinin sona ermesi durumunda, onun son rapor ve kesin hesabı vermesi ile vesayet altındaki kişinin mallarını teslim etmesi MK 489. maddede düzenlenmiştir. Bu aşamada da vesayet dairelerinin, bu işlemlere nezareti, son raporu ve kesin hesabı incelemesine yönelik görev ve yetkileri bulunmaktadır. Vesayetin yürütülmesi esnasında vesayet dairelerine tanınan yetkiler ile üzerlerine düşen görevler gibi, vasinin görevine başlaması ve görevinin sona ermesinde dairelerin görev ve yetkilerinin tümü, vesayet altındaki kişinin menfaatlerinin korunmasına yöneliktir. Vesayet dairelerinin görev ve yetkileri de bu çerçevede, yani vesayet altındaki kişinin menfaatlerinin korunması bağlamında değerlendirilmeli, onlar da vasinin görev ve yetkilerine müdahale etmeden, kendilerine tanınan görev ve yetkileri kullanırken bu amaç çerçevesinde hareket etmelidirler.
Abstract
The guardianship offices (guardianship authority and supervisory authority) have various powers and duties both at the beginning and after the expiry of the guardian's duty, in addition to their powers and duties along the period during which the guardian exercises his/her duty (transactions requiring authorization, complaint and objection). Such powers and duties relate to the matters and transactions that need to be performed at the beginning of the guardian's duty as provided in Articles 438 to 444 of the Civil Code. The foregoing provisions regulate matters and transactions to be performed at the beginning of the guardian's duty with respect to the bookkeeping, the safekeeping of valuable articles, the sale of movable and immovable property, the deposition of money and the conversion of investments, as well as the powers and duties of guardianship offices in this regard. Moreover, the submission of the final report and the final account as well as the delivery of the properties of the person under guardianship, i.e. the ward, by the guardian is regulated under Article 489 of the Civil Code. At this point, the guardianship offices have powers and duties with regard to the monitoring of the said transactions and the review of the final report and the final account. The powers granted to and the duties imposed upon the guardianship offices with respect to the exercise of the guardianship, as well as their powers and duties in relation to the beginning and expiry of the guardian's duty are all aimed at the protection of the ward's interests. The powers and duties of the guardianship offices should also be considered within the context of the protection of the ward's interests, and they should act in accordance with this purpose in the exercise of their powers and duties without interfering with the guardian's powers and duties.
