Özet

Résumé : La conception d’une démocratie locale participative et semi-directe peut être envisagée dans le cadre de la Constitution de 1958 suite à la révision constitutionnelle de 2003. Malgré la structure unitaire de la République, l’attachement à la démocratie représentative et la domination de la forte tendance française de centralisation, les premières tentatives de mise en œuvre d’une démocratie locale montent au début du 20 e siècle. Cependant, la première reconnaissance d’un référendum consultatif local par le législateur date de la fin du 20 e siècle. La portée du référendum local consultatif initialement prévu pour les communes avec la loi du 6 février 1992, a été ultérieurement étendue par d’autres lois jusqu`à 2003. De plus, introduit par la révision constitutionnelle de 2003, l’article 72-1 de la Constitution prévoit un droit de pétition au niveau local, et deux types de référendum local : l’un décisionnel et l’autre consultatif. Comme tous ces outils de participation des citoyens sont soumis au contrôle juridictionnel, le Conseil d’État, grâce à sa jurisprudence, a pu créer un régime de contentieux portant non seulement sur l’acte par lequel la décision d’organiser un référendum est prise, mais aussi sur le résultat du référendum.

Abstract

A participative and semi-direct conception of democracy on a local level in France has a constitutional basis since the constitutional amendment, which was adopted in 2003, regarding the decentralization of French Republic. Despite the unitary organization of French Republic, the strong attachment to representative democracy and dominance of centralism in French political tradition, attempts for a more participative local democracy can be traced back to the beginning of 20 th century. However, the legislature had not recognized a local advisory referendum until the end of 20 th century. Scope of the local advisory referendum, which was limited to communes as adopted by the law on local and regional authorities in 1992, has also been extended before 2003. Article 72-1 of the French Constitution, as amended in 2003, foresees regarding all local and regional authorities an extended right to petition on a local level and two different types of local referendum, one binding and the other advisory. As all these procedures of participative local democracy is under judicial scrutiny, French Council of State has developed a judicial review regime regarding the decision to organize a referendum and its result.
