Özet

İnsan onuru kavramının tam olarak nasıl anlaşılması gerektiği konusunda tam bir fikir birliğinden söz edilememekle birlikte, kavramın yalın ve soyut olduğunu söylemek de bir o kadar zordur. İnsan onuru kavramı, birçok uluslararası belge ve belirli anayasalarda yer alsa da bu metinlerin birçoğunda kavramın tanımlanmamış olduğu görülmektedir. Bu makalede özellikle Nazi dönemi tecrübesi nedeniyle Alman anayasacılığında son derece önem taşıyan ve Federal Alman Cumhuriyeti Anayasası’nın birinci maddesinde vücut bulan insan onuru kavramının tanımı ve nitelikleri incelenmiş, kavramın tarihsel gelişimi, otoriterelere karşı bireyi yetkilendirme ve bireyi sınırlandırma şeklindeki iki yönlü kullanımı ve Alman Anayasa Mahkemesi kararları ile Alman doktrinine yansımaları üzerinde durulmuştur.

Abstract

Not only exists there not a consensus about the issue of how the notion of human dignity should be understood, it is also not easy to admit that it is a simple and abstract notion. The concept of human dignity is manifested in several international documents as well as in certain constitutions; nonetheless, in most of these texts the notion still remains undefined. Due to its substantial importance in the German Constitutionalism particularly because of the Nazi Period experience, this paper after examining the definition and the attribution of the concept of human dignity which is embodied in the first article of the Constitution of the Federal Republic of Germany, focuses on its historical development and addresses the bidirectional role played by the notion: the authorization of the individual against authorities and limitation of the individual’s freedom. Finally the focus is laid on the reflections of the notion on the German doctrine and on the decisions of the German Constitutional Court.
