Cumhurbaşkanlığı Hükûmet Sistemi ve İdari Yapıya Etkisi

Özet

Bu makale, 2018 yılı Temmuz ayı itibarıyla parlamenter sistemden başkanlık sistemine geçiş yapan Türkiye’deki değişimi ilk olarak siyasal yapı, sonrasında da idari yapıdaki dönüşümler çerçevesinde incelemektedir. Çalışmada, yeni sistemde Cumhurbaşkanına verilen yetkiler ortaya konarak analiz edilmektedir. Cumhurbaşkanına asli düzenleme yetkisi veren ve özerk bir alan tanıyan Cumhurbaşkanlığı Kararnameleri ile merkezi yönetimi bünyesine katan yeni Cumhurbaşkanlığı teşkilatı ayrıntılı irdelenmektedir. Çalışmanın son kısmında ise özellikle siyasal sistemin niteliği açısından ABD Başkanlık Sistemi ile karşılaştırma yapılarak okuyucuya toparlayıcı bir değerlendirme sunulmaktadır.

Abstract

This paper analyzes the changes in Turkey which transitioned to the presidential system from a parliamentary system as of July, 2018, first in terms of political structure; then in terms of the transformations in the administrative structure. In this study, the powers given to the President in the new system are revealed and analyzed. The Presidential Decrees, which give the President the authority to primary regulation and grant an autonomous field, and the new Presidency organization that swallows the central administration are studied in detail. In the last part of the study, a comprehensive evaluation is presented to the reader by making comparison to the USA Presidential System, especially in terms of the qualification of the political system.
