MUSUL MESELESİ SÜRECİNDE MİLASLI GAD FRANKO VE ÇALIŞMALARI

Özet

Bu çalışmada, Türkiye’nin en ünlü hukukçularından biri olan Milaslı Gad Franko’nun Musul meselesi sürecindeki tutumu ve bu konuya ilişkin yapmış olduğu çalışmalar konu edilmiştir. Özellikle, Musul meselesinin Cemiyet-i Akvâm’a gitmesi öncesinde ve sonrasında Türkiye’nin lehine yapmış olduğu ve pek bilinmeyen çalışmalar üzerinde durulmuştur. Bu nedenle, çalışmanın giriş kısmında, Cemiyet-i Akvâm’a gitmesine kadar Musul meselesinden kısaca söz edilmiştir. Ayrıca, bu kısımda Milaslı Gad Franko hakkında çok kısa biyografik bilgi verilmiştir. Çalışmanın asıl kısmının ilk bölümünde; Musul meselesinin Cemiyet-i Akvâm’a gitmesi, Türkiye’nin bu gelişme karşısında yapmış olduğu çalışmalar, Türkiye’nin bu konuda uluslararası hukuku devreye sokması, uzman görüşlerine başvurması hem arşiv belgeleri, hem de dönemin basını kullanılarak ortaya konulmuştur. Çalışmanın ikinci bölümde ise; Musul meselesinde Türkiye’nin görüşlerine başvurduğu, danışman olarak görevlendirdiği Milaslı Gad Franko’nun bu konuda yapmış olduğu çalışmalara yer verilmiştir. Bu bağlamda; Milaslı Gad Franko’nun Fransa ve İsviçre’de yapmış olduğu “tetkikât” ve Türk heyetine vermiş olduğu “tenbihât” hakkında belgeler ışığında bilgiler verilmiştir. Çalışmanın sonuç kısmında ise, Musul meselesi sürecinde Türkiye’nin lehine önemli çalışmalarda bulunan, görüşler ortaya koyan Milaslı Gad Franko’nun yapmış olduğu çalışmalar değerlendirilmiş, yorumlar yapılmış, bir takım sonuçlara varılmıştır.

Abstract

In this study, the attitude of Milaslı Gad Franco, who was one of the most famous lawyers in Turkey, in Mosul process and his works were done on this issue has been subject. Particularly, Mosul before going to the League of Nations and later unknown works that has been done in favor of Turkey were focused on. Therefore, in the introduction of the study, the history of Mosul until its arrival to the League of Nations was briefly mentioned. In addition, very short biographical information was provided about Milaslı Gad Franko. In the first part of the main part of the study; Mosul question was gone to the League of Nations, studies that Turkey was made in the face of these developments, Turkey’s put in international law on this question, was applied to expert opinions were revealed to use both archival documents and the press of the period. In the second part of the study, Milaslı Gad Franko’s, who was referred to Turkey’s opinion in Mosul question and was commissioned as a consultant works were given. In this context, Milaslı Gad Franko’s was done “researches” in the France and Switzerland and the “advices” was given Turkish delegation were demonstrated in the light of documents. In the conclusion of the study, Milaslı Gad Franko’s studies on the question of Mosul was evaluated. In addition, various comments were made, a number of conclusions were reached.
