Mecelle'de Akid Teorisi

Özet

Akid, insanlığın en eski asırlardan beri bildiği bir muameledir. Akid şekli, sınırı ve yeri bakımından hukuk tarih içerisinde çeşitli devrelerden geçerek gelmiştir. İradeye saygı ve irade hürriyetinin tesiri açısından akid insanlık için önemli bir muamele aracı olarak işlev görmektedir. Toplumla iç içe yaşayan her insan hayatını devam ettirebilmek için diğer insanlarla muameleye girmek zorundadır. Bu durum onun bir takım ihtiyaçlarını gidermek zorunda kalmasından kaynaklanır. İhtiyaçların hukukun sınırları içerisinde giderilmesinin en pratik yolu akidlerdir. Bu nedenle akid hem fert hem de toplum hayatı için önemli bir olgudur.

Abstract

Contract is a treatment that mankind has known for the oldest centuries. In terms of its form, boundary and location, the law has passed through various circuits in history. It acts as an important treatment for the covenant of humanity in terms of the effect of respect for the will and the freedom of will. Every human living in society has to be treated with other people in order to continue his life. This is due to the fact that he has to satisfy a number of needs. The most practical way of eliminating the requirements within the limits of law is the contracts. Therefore, the contract is an important phenomenon for both individual and community life.
