Makalemizde, 26.12.2012 tarih ve 28509 sayılı Resmi Gazete'de yayımlanan Bağımsız Denetim Yönetmeliği ile 6102 sayılı Türk Ticaret Kanunu ve 660 sayılı Kanun Hükmünde Kararname hükümleri de dikkate alınarak bağımsız denetçi olabilmenin şartları ele alınmıştır. Yönetmelik düzenlemesi ile bağımsız denetçi olacaklarda ikili bir ayrıma gidilmiştir. Buna göre, Yeminli Mali Müşavirler (YMM) ve meslekte 15 yılını doldurmuş Serbest Muhasebeci Mali Müşavirler (SMMM) açısından getirilen düzenlemeler ile 15 yılın altında mesleki tecrübesi bulunan SMMM'ler açısından getirilen düzenlemeler farklıdır. Bu nedenle, iki başlık oluşturulmuş ve konunun daha anlaşılabilir olması arzulanmıştır. Ayrıca bağımsız denetim şirketi kurabilmenin şartları da ayrı bir başlık altında ele alınmıştır. Son olarak ise, konuyla ilgili olarak kafalarda oluşabilecek sorular ve bu soruların cevaplarına yer verilmiştir.
Our article addresses the conditions for being an auditor by taking into account the provisions of Independent Audit Regulation published in the Official Gazette no. 28509 dated 26.12.2012 and the Turkish Code of Commerce no. 6102 as well as of the Cabinet Decree no. 660. People who will be independent auditors have been grouped into two with a regulation. According to this, the regulations made for Sworn Financial Advisors (YMM) as well as Independent Auditor Sworn Financial Advisors (SMMM) who have completed 15 years in the profession and for Independent Auditor Sworn Financial Advisors who have experience of below 15 years are different. Therefore, two titles have been created and the issue was targeted to be more comprehensible. Besides, the conditions for establishing an independent audit company have been covered under another title. Finally, the questions that may arise regarding the issue and answers to these questions have been covered.
