Türkiye’nin lider sektörlerinden biri olan İnşaat sektörü özellikle KDV iadesi konusunda ciddi sorunlar yaşamakatadır. 119 seri nolu KDV Genel Tebliği ile yeni düzenlemeler yapılmış olmakla birlikte, uygulamada hala tartışmalı konular bulunmaktadır. Özellikle Yapı Denetim Masrafları, Kat Karşılığı Arsa Teslimlerinde Emsal Bedel, KDV İadesinin Ne Zaman Talep Edilebileceği gibi temel bazı alanlarda sorunlar devam etmektedir. Net bir yapıya sahip olmayan düzenlemelerden dolayı pek çok vergi dairesinde farklı uygulamalara da rastlanılmaktadır. Bu nedenle aynı konuda farklı zamanlarda ve farklı dairelerde çok farklı uygulamalara rastlanılabilmektedir. Sektördeki yüksek oranlı kayıt dışılık İdareyi KDV İadeleri konusunda daha hassas davranmaya itmekte, her bir teslim ve iade talebi Vergi Dairelerinde daha detaylı kontrole tabi olmaktadır.
The Construction sector having important role in Turkish Economy faces some problems regarding VAT refund process. Although there are new regulations and explanations made by the general communiqué on VAT serial no. 119, VAT Refund on the construction sector is stil controversial issue in practise. On the VAT Refund process, many problems raise from the Construction controlling expenses, delivery value of the house or offices on the flat for the land basis construction, VAT Refund time etc. Because of the unclear position of the VAT Refund process of the construction sector, many tax offices have different implementations and requirements. These kind of unclear process lead problems and tax payers and tax authority act different for the same application in different times. I believe that tax offices wish to check all details in VAT Refund applications because of the shadow economy in the construction sector. Many limitations focus on the catching up this part of shadow economy.
