Suçsuzluk karinesi

Suçsuzluk karinesi, kişinin suçluluğu ispatlanıncaya kadar masum sayılmasını ifade eden bir ilkedir. Suçsuzluk karinesi, adil yargılanma hakkının en önemli unsurlarından birisidir. Bu hak evrensel bir ilkedir. Bu kapsamda ilkenin Evrensel İnsan Hakları Bildirisi’nde ve Avrupa İnsan Hakları Sözleşmesi’nde de yer aldığı görülmektedir. Avrupa İnsan Hakları Sözleşmesi’nin 6/2’nci maddesi “Bir suç ile itham edilen herkes, suçluluğu yasal olarak sabit oluncaya kadar masum sayılır” demektedir. Bu çalışmanın konusu suçsuzluk karinesidir. Konu Avrupa İnsan Hakları Sözleşmesi’nin 6/2’inci maddesi ve Avrupa İnsan Hakları Mahkemesi kararları bağlamında ele alınmıştır. İlaveten suçsuzluk karinesi ile basın arasındaki ilişki de incelenmiştir. İkisi arasındaki sorunlara çözüm önerileri sunulmuştur.

The Presumption of innocence is the principle that one is considered innocent until proven guilty. The presumption of innocence is one of the most important elements of right to a fair trail. This right is a universal principle. In this respect it can be seen that the principle is included in the Universal Decleration of Human Rights and the Convention for the Protection of Human Rights and Fundamental Freedoms. The Convention for the Protection of Human Rights and Fundamental Freedoms says (art. 6.2): "Everyone charged with a criminal offence shall be presumed innocent until proved guilty according to law". The subject of this paper is the the presumption of innocence. This issue is dealt with in the context of the main rule of article 6/2 of The Convention for the Protection of Human Rights and Fundamental Freedoms and the European Court of Human Right’s desicions. Additionaly, the relation between the presumpiton of innocence and the press is dealt with. With regard to some problems(between the presumpiton of innocence and the press), the solution methods are proposed.
