Türk ceza hukukunda şahısta hata ve hedefte sapma

Bu çalışmada, Ceza Hukuku bağlamında ele alınan «şahısta hata» ve «hedefte sapma» konuları işlenmiştir. Gerek öğretide ve gerekse uygulamada farklı şekilde ele alınan ve böylece farklı sonuçlara tâbi tutulabilen şahısta hata ve hedefte sapma müesseseleri, uygulayıcılar açısından büyük öneme sahiptir. Diğer yandan, birbirine yakın özelliklere sahip şahısta hata ve hedefte sapma olguları, bir o kadar da farklı sonuçlara götürür. Bu açıdan da faile ilişkin bir önemi vardır. Öncelikle konunun iyi anlaşılması ve böylece doğru sonuçlara ulaşılabilmesi amaçlanmıştır.

This paper presents research on «error in persona» and «aberratio ictus» which are discussed in the context of Criminal Law. The concerns (institutions) of error in persona and aberratio ictus which are differently dealt both in principle and application and thus, processed to different results, are of great importance to the practitioners (law enforcement personel). On the other hand, while the concerns (institutions) of error in persona and aberratio ictus have similar (close) features in common, they are also processed to totally different results. Therefore, in this respect, it has a significant importance related to the criminal. What is aimed here first is that especially the case itself should be understood exactly and then the right results are to be gained.
