Avrupa birliği ve türkiye’de deniz taşımacılığı sektöründe rekabet hukuku uygulamaları

Avrupa Birliği rekabet hukuku kapsamında çesitli değisikliklere uğramıs olan deniz tasımacılığına iliskin kurallar son düzenlemeler sonucunda tamamen rekabet hukukunun konusu haline gelmis ve sektöre verilen önem doğrultusunda deniz tasımacılığına iliskin kılavuzlarla da rekabet hukuku düzenlemeleri daha da açıklığa kavusmustur. Bunun yanında Türkiye'nin deniz tasımacılığı sektöründe henüz hak ettiği yerde olmadığı bir gerçektir. Bunun bir sonucu olarak rekabet hukuku açısından da henüz Avrupa Birliği'nin sahip olduğu birikime henüz sahip olmamıstır. Buna rağmen, Avrupa Birliği'ndeki gelismelerin takip edildiği sinyallerini veren Rekabet Kurulu kararlarının olusmaya basladığı da gözlemlenmektedir. Bu kapsamda, AB'nin geçmisten günümüze atmıs olduğu adımları, gelisimlerini aktarma ve Türkiye'de ne asamada olunduğunu kıyasen gösterme amacıyla söz konusu makale hem Avrupa Birliği rekabet hukuku hem de Türk rekabet hukuku açısından geçmis ve halihazırdaki uygulamaları göstermektedir.

Maritime transportation has been subject to various changes within the scope of European Union competition law and as a result of the latest amendments, it has completely become the subject of competition law and in line with the importance regarded for the sector, the competition law regulations have been clarified through the guidelines on sea transportation. Additionally, it is a fact that Turkey is not in a position that it deserves to be in the sea transportation sector. As a result, compared to European Union, there is no such knowledge in terms of competition law. Nevertheless, it is observed that there are various decisions of the Competition Board which signals the follow ups on the developments in the European Union. In this respect, in order to portray the steps taken by the European Union and the developments thereof, and comparatively show the state of Turkey, this article is focused on both the previous and current practices in terms of European Union competition law and Turkish competition law.
