Self-determinasyon hakkı ve filistin devleti bağlamında filistin sorunu

Filistin Sorunu hakkında çok sayıda çalışma yapılmış olmasına rağmen, literatürde self-determinasyon bağlamında sorunun yeterince incelenmediği görülmektedir. Günümüzde birçok bölgede tartışmalı bir konu olan self-determinasyonun Filistin Sorunu açısından incelenmesi, sorunun çözümüne yönelik bir söylem yaratabilmesi bakımından önemlidir. Çalışmada, Filistin Sorunu bağlamında self-determinasyonun yeri, konunun uluslararası hukuk açısından gelişimi ve sonuçları incelenmiştir. Öncelikle, self-determinasyon kavramı tarihsel süreciyle ve Birleşmiş Milletler kararlarından hareketle anlatılarak, bu noktalardan Filistin Sorunu'na uygulanabilirliği için dayanak noktaları aranmıştır. Daha sonra, Filistin Devleti'nin kurulması siyasi yönleriyle ve Birleşmiş Milletlerin konuya yönelik kararları ve görüşleri temelinde incelenmiştir. Sonuç olarak, self-determinasyon ve iki devletli çözüm tartışmalarının devlet kurma sürecini hızlandırıcı etkenler olmasına rağmen, bu durumun Filistin Sorunu için tam olarak çözüm sağlayamayacağı belirtilmiştir. Filistinli mülteciler, Doğu Kudüs, duvar inşası, Ġsrailli yerleşimciler gibi birçok belirleyici sorunun çözümsüz kalmaya devam etmesi bu durumu destekler niteliktedir.

Although there are lots of papers have written about the problem of Palestine, it is seen that the problem has not been examined sufficiently in the terms of self-determination. Investigating the Palestine problem from the point of self-determination which is disputable today in many regions is very important to create an expression for the solution of the matter. In the study, place of self-determination, its process in terms of international law and its results are examined in Palestine problem regard. The term of self-determination is primarily mentioned with the historical process and by the decisions of United Nations and reference points are searching to apply these points to the Palestine problem. Then, establishing Palestine State with its political sides and the decisions and opinions of the United Nations about the subject are reviewed. As a result, although there exist some accelerating factors in stating process of self-determination and two-state solution, it is emphasized that this situation does not ensure a solution precisely. Some unsolvable decisive problems such as Palestinian refugees, East Jarusalem, construction of wall, the settlers of Israel support this situation.
