Sendikal hakların kullanılmasının engellenmesi suçu

Çalısmanın konusunu, Türk Ceza Kanunu’nun 118. maddesinde düzenlenmis olan “sendikal hakların kullanılmasının engellenmesi suçu” olusturmaktadır. Bugüne kadar bu konuya iliskin ayrıntılı bir çalısma yapılmamıs olması ve konunun çesitli sorunları içermesi nedeniyle söz konusu suçu inceleme geregi duyduk. Çalısmada; öncelikle sendikal hak kavramını ve Türkiye’deki durumu, daha sonra suçun yapısal unsurlarını, suça etki eden nedenleri ve yaptırım konularını inceledik. Sonuç kısmında ise, sendikal hakların kullanılmasının engellemesi suçuna iliskin ulastıgımız kanaat ve önerileri ifade ettik.

In the 118th article of the Turkish Criminal Code, “Prevention of Use of Syndical Rights” has been enacted. We considered it necessary to examine this crime due to the fact that this topic has not studied or researched in details before and that, it implies numerous  problems. In this work, before all else, we dealt with the concepts of syndical rights and the current situation in Turkey. Then, we analysed the structural elements of the crime, the grounds affecting the crime, the special formation and the sanction thereof. In the conclusion part, we set down the consequences we deduced and the proposals on Prevention of Use of Syndical Rights.
