Transfer of businesses or parts of businesses has been arranged in the article 6 of the Employment Act No.4857 in detail and in conformity with the Council Directive 2001/23/EC of 12 March 2001 on the approximation of the laws of the Member States relating to the safeguarding of employees' rights in the event of transfers of undertakings, businesses or parts of undertakings or businesses.

In the field of Labour Law practice, the protection of employees and to ensure the safeguarding of their rights are the most important subjects in the event of the transfer of businesses or parts of businesses especially the economic conditions of the present day is taken into consideration. In this article, business and undertaking has been defined and the effecets of the transfer of business or parts of bussiness on the employment contracts have been analyzed due to the arrangements in the Employment Act No.4857 and the Council Directive 77/187/EEC which has been amended by the Council Directive 2001/23/EC.
