Recm cezasının hz. peygamber’in uygulamaları işığında değerlendirilmesi

Bir toplumun huzur ve refahı, o toplumu oluşturan ailelerin sağlam temeller üzerine kurulmasına bağlıdır. Aile kurumuna büyük zararlar vermesi, nesli bozması ve toplumsal hayatın huzurunu tehdit etmesi gibi nedenlerle, zina suçuna ağır cezai müeyyideler öngörülmüştür. Evli insanların zinalarında, fert ve toplumda söz konusu yıkımların katlanarak arttığı bir gerçektir. Dolayısıyla evlilerin zinasında, sahih sünnet ve icma ile recm cezası takdir edilmiştir. Hz. Peygamber'in recm cezasıyla ilgili uygulamaları bu bağlamda büyük önem arz etmektedir. Bu çalışmada Hz. Peygamber'in evlilerin zinasıyla ilgili had uygulamaları; sened, metin ve bu uygulamaların celde ayetinin nüzulünden önce veya sonra oluşu değerlendirilmiştir.

Peace and prosperity of a society depends on constituting the families, which are formatters of that society, on sound basis. Severe penal sanctions are proposed for the crime of adultery because of the serious damages it gives to family, its annulment of the generation and the threats it poses against the peace of social life. It is a fact that these disasters increase incrementally within family and society when married people commit the crime of adultery. Therefore, punishment of stone to death is appraised by the authentic sunna and assent for married people's adultery. The Prophet's practices regarding the punishment of stone to death are of great importance. Within this study, the Prophet's maximum level of practices concerning the adultery of married people; sanad, matn and the question of whether these practices are carried out before or after the revelation of the verse of celde (cudgeling) have been evaluated.
