Mâverdî’nin hilâfet anlayişinda meşruiyet sorunu

Ebu’l-Hasan el-Mâverdî İslâm hukuk ekollerinden biri olan Şafiî Mezhebinin yetiştirdiği en önemli hukukçulardan biri olup imâmet ve hilâfet konusunu müstakil bir eserde yazmış âlimlerimizdendir. Abbâsî Devletinin son yıllarında hilâfet makamı sembolik bir anlam ifâde edecek kadar gücünü kaybetmişti. Bu dönemdeki sosyal ve siyasal şartlar, hilâfet makamını tehdit edecek seviyede idi. Bu nedenle halîfeler ulemânın desteğine ihtiyaç hissettiler. Bürokrasideki tıkanmışlığı gidermek amacıyla onların çözüm önerilerinde bulunmaları gerekiyordu. İşte İmâm el-Mâverdî de böyle bir dönemde yaşayan bir âlim ve bürokrat olarak hem halîfeyi, hem hilâfeti, hem de ümmetin siyâsî-idârî birliğini korumak ve kollamak amacıyla “el-Ahkâmu’s-Sultâniyye” adlı eserini yazarak saltanatı meşrulaş-tırma ve Abbâsî hilâfetinin meşruiyetini dinî nasslar desteğiyle koruma gayretini verdi. Böylece Büveyhî ve Selçuklu yöneticilerin kazandığı güç karşısında halîfenin manevî ve siyasî  gücünü koruma  gayretini  sürdürdü.  Bu  makalemizde  el-Mâverdî’nin  geliştirdiği hilâfet modeli ekseninde hem hilâfet konusunu, hem de Abbâsî hilâfetini irdeleyeceğiz.

Abu al-Hasan al-Mawardi was an Islamicjurist of the Shafi’i school most remembered for his works on religion, government, the caliphate, and public and constitutional law during a time of political turmoil. Al-Mawardi was an intellectual with virtues who worked for a just and satisfying social and political environment. He was an important religious and political actor in the decline period of the caliphates of the Abbâsîds. A symbol of his contributions here, he is well remembered for his treatise on “The Ordinances of Government.” The Ordiances, Al-Ahkâm al-Sultaniyya w’al-Wilayat al-Diniyya, provide a detailed a definition of the functions of caliphate government which, under the Buyids and Seljuqs appeared to be rather indefinite and ambiguous. For al-Mawardi the caliphate symbolized an entire politico-religious system that regulates the lives of men in a Muslim community to the smallest detail. At this the work al-el-Mâverdî revealed example of a model of the Caliphate. In this article, I will investigate work of the author an administration model in terms of legimacy.
