The environmental pollution and excessive use of the resources threat our world seriously can be considered as a great dangerous. Especially with parallel to the increase of population, the areas like sea, air and water which are under the common usage of human being became more polluted and the quality of these areas decreases continuously. The range of this pollution is not restricted only with land, it includes the air, the seas and fresh water resources too. One of the reason of this problem stems from property rights. Under the pretext of property rights people continually exploits this common areas. The main question is this, to which extend people will exploit these areas and when this usage harms environment, can be a restriction brought to the content of property rights? In this article, with perspective of Islamic Law, the relation of environment and property rights will be examined.
