Türk hukukunda oturma hakkı

İrtifak hakkı ayni bir hak olup, hak sahibine o eşyadan yararlanma yetkisi verir. Ancak hak sahibine tanıdığı bu yetki sınırlıdır. Medeni Kanunumuz irtifak türlerini taşınmaz lehine irtifak hakkı, intifa hakkı, oturma hakkı, üst hakkı, kaynak hakkı ve diğer irtifaklar olarak belirlemiştir. Söz konusu bu irtifaklar sınırlı sayıda (numerous clausus) olup, bunların dışında irtifak hakkı kurmak mümkün değildir. Makalemizde irtifak haklarından biri olan oturma (sükna ) hakkı ayrıntılı bir şekilde ele alınmıştır. En geniş yetkileri veren mülkiyet hakkından ve diğer ayni haklardan farkları ortaya konmuştur.
