Türkiye’de sağlık turizmi ve sağlık turizmi hukuku

Tüm insanların ortak kaygılarından birisi saglıktır. Bireyler bu konuda psikolojik, fizyolojik ve çevresel açıdan mümkün olan en iyi durumda ve sartlarda olmayı amaçlar. Saglıkla ilgili kurumlar ise bireylere bu konuda en iyi hizmeti vermeye çalısır. Saglıkla ilgili en önemli referans kurumlardan birisi olan Dünya Saglık Örgütü saglıgı; "zihnen, bedenen ve sosyal açıdan tam bir iyilik hali" olarak tanımlamıstır. Ikinci dünya savası akabinde sosyal devlet anlayısının önem kazanması ile birlikte saglık hakkı bir vatandaslık hakkı olarak tanınmıs ve devletler vatandaslara sistematik olarak saglık hizmeti saglayacak ulusal saglık sistemleri olusturmaya baslamıstır. Saglık hakkı Insan Hakları Evrensel Bildirgesi'nde yer bulmustur ve Birlesmis Milletler Ekonomik, Sosyal ve Kültürel Haklar sözlesmesi en yüksek saglık standartlarına ulasma hakkını güvence altına almıstır. Uluslararası insan hakları belgeleri yanında Anayasamızın 56. Maddesi de saglık hakkını düzenleyip güvence altına almıstır. Saglık alanında hayata geçirilen neopolitikalar akabinde devlet yavas yavas saglık sektöründeki hizmet saglayıcı rolünden vazgeçmis ve düzenleyici bir rol üstlenmeye baslamıstır. Bu gelismelerle birlikte saglık sektöründe özel sektör büyük bir rol üstlenmeye baslamıstır. Bu baglamda daha kaliteli veya ucuz saglık hizmeti satın almak isteyenler tedavi amacıyla baska ülkelere gitmeye baslamıslardır. Ticari olarak döviz elde etmek isteyen devletler de çesitli tesviklerle ve vergi indirimleriyle saglık turizminin gelismesi dogrultusunda politikalar olusturmuslardır. Turizim dünya çapında hızla gelisen bir sektördür ve ülkeler için ekonomik ve sosyal açıdan önem teskil etmektedir. Daha önceleri sadece tatil ve seyahat amaçlı olarak görülen turizm, son yıllarda saglık turizmine dönüsmüstür. Saglık turizmi bireylerin, saglıklarını korumaları ve saglıklarıyla ilgili olumsuz durumları ortadan kaldırmaları amaçlarına yardımcı olmak için ortaya çıkmıs bir olgudur. Son yıllarda daha çok karsımıza çıkan saglık turizminin her geçen gün önemi ve yaygınlıgı artmaktadır. Bireyler için fayda saglayıcı amaçları olan saglık turizminin belirli esaslara göre yapılması için hukuksal düzenlemelerin yapılması ve yasal çerçevelerin olusturulması sarttır. Bu çalısma, her geçen gün daha da yaygın hale gelen ve uygulama alanı artan saglık turizmini ve beraberinde saglık turizmi hukukunu incelemek amacıyla yapılmıstır.

One of the common concerns of all people is the health. In this regard, individuals strive to be in best possible psychological, physiological and environmental conditions. Health-related institutions try to give the best service to the individuals in this aspect. The World Health Organization, one of the most important reference agencies related to health, defines the health as "mentally, physically and socially a complete well-being". Following World War II, along with the importance of the concept of welfare state, right to health recognized as citizenship right and states have started to build national health systems to provide health care services systematically. The right to health enshrined in the Universal Declaration of Human Rights and the United Nations Convention on Economic, Social and Cultural Rights guarantees to access to the right to the highest attainable standard of health. Besides international human rights instruments, Article 56 of the Turkish Constitution regulates and secures the right to health. With implementation of neo-policies, the states gradually have given up their service provider role and started to play a regulatory role. As a consequence, private health sector has started to play a major role in the health sector. In this respect, the patients, wishing to receive better quality or cheaper health care, have tend to go to other countries for treatment. The states that aim to get profit have started to design health tourism policies such as cutting taxes or providing incentives for the private sector. Tourism is one the fastest developing sectors in the world with a growing importance for the countries on both economic and social aspect. Previously regarded for intensions like vacation and travel, tourism nowadays is transforming into a shape in the manner that health tourism. Health tourism has appeared to protect the health of individuals and eliminate the adverse conditions. As a new phenomenon, the importance and prevalence of health tourism is increasing each day. Health tourism provides benefits to the individuals; therefore it is essential to create principles and legal framework. The main purpose of this study is analyzing the profile of health tourism in Turkey and in some other countries, making a comparison and investigating the possibilities for improvements.
